Terms of InsChain Canine Pet's Owner Liability Mutual Aid Program
1.Purpose
The Canine Pet’s Owner Third-party Liability Mutual Aid Program (hereinafter referred to as "the Program") is launched by the InsChain Mutual Aid Platform (website: https://www.inschain.io) based on the principle: “One for all and all for me”mutual benefits. In the event that a member has an accident due to personal responsibility (as defined in Article 2.1), other members are obliged to offer helps.

2.Content
2.1 In case of accidental raids and/or biting behaviors of the canine pet (applied to canine pet with government issued dog-raising licence and the immunization licence) from mutual aid members,it has caused others’ direct medical accident losses exceeding 5,000 RMB or getting rabies due to canine pet’s responsibility, other mutual aid members under the Program shall initiate mutual aid. (hereinafter referred to as “Pet Owner’s Liability”).

2.2 The mutual aid member will be eligible for the Program during the period from the expiration of 30 days(hereinafter referred to as “Waiting Period”) starting the following day after his/her participation in the Program and his/her qualification as a mutual aid member to the age of 60 full years old. 

2.3 Mutual aid members shall be obliged to provide mutual aid in mutual aid events in an equally distributed manner and in the amount no more than 5GETX per person each time.

2.4 Mutual aid amount for the accident loss due to the Pet Owner’s liability= number of valid participants in the Mutual Aid Program launched that day × 5GETX, with the upper limit no more than 10,000 GETX.

3.Participation Conditions
A mutual aid member shall meet a combination of following conditions in order to participate in the Program:

3.1He/she is aged between 16 and 60 full years old (including 60);

3.2In accordance with conditions by local government authorities for animal maintenance, companies/individuals who have full civil capacity have the pet-raising licence and  immunization licence;

3.3 He/she acknowledges and undertakes to abide by the insChain Mutual Aid Member Covenant, the Program and this contract;

3.4 He/she makes deposits to the personal account opened at the insChain Mutual Aid Platform.


4.Mutual Aid Membership Surviving Conditions and Obligations 
The mutual aid member fails to perform following obligations in accordance with the agreement, the mutual aid platform reserves the right to cancel his/her membership:

4.1 The mutual aid member automatically withdraws from the Program when he/she applies for a mutual aid fund due to Pet Owner’s liability.

4.2 Mutual aid members should continue to recharge his/her account maintaining mutual aid membership. The platform shall send warnings by emails to members when the membership account balance is insufficient.

4.3 The rights and interests of mutual aid for the Program shall cease to be in force automatically upon the first day of the following month after the mutual aid member reaches 60 full years old.

4.4 The insChain Mutual Aid Platform will deduct the management and administration fees every day. Where a member fails to pay in time, he/she will be disqualified from obtaining the mutual aid and denied from the right to apply for and the mutual aid. He/She shall receive no mutual aid from mutual aid events occur during the period. Even if the member is in the process of the application for mutual aid fund, he/she will be deemed to waive the application on his/her own initiative. The membership shall be subject to the following situations after suspension:

(1) The qualification for mutual aid shall be restored at midnight of the following day after the settlement of the arrears within 30 days.

(2) Where the member fails to settle the arrears within 30 days, he/she will be considered as withdrawing voluntarily. If the member rejoins in the Program, corresponding conditions of participation shall be qualified.And the Waiting Period will be recalculated.

4.5 Where the member fails to pay in full the equally distributed amount for the latest event or the mutual aid account balance less than 5 GETX , he/she will be deemed to withdraw automatically, thus disqualified as a member, denied of the obligation of equal distribution, as well as the rights and interests of mutual aid during suspension. Even if the member is in the process of the application for the mutual aid fund, he/she will be deemed to waive the application on his/her own initiative. The membership shall be subjected to following situations after suspensions:

(1) The qualification of mutual aid shall be restored at midnight of the following day after the settlement of the arrears within 30 days.



(2) Where the member fails to settle the arrears within 30 days, he/she will be considered as withdrawing voluntarily. If the member rejoins in the Program, corresponding conditions of participation shall be qualified.And the Waiting Period will be recalculated.

4.6 Other circumstances specified in insChain Mutual Aid Member Covenant and this Regulation.

4.7 As the Platform officially processes the application for mutual aid, the membership will be frozen. After investigation completed, the Platform will complete procedures for the member’s withdrawal from the Program.

4.8 Mutual aid members shall follow local government authorities’ regulations for animal maintenance and fulfill their responsibilities as animal caretakers.Members should enhance management, take reasonable preventive measures, and try to avoid/reduce the occurrence of liability incidence.

4.9 The Mutual Aid Platform may check mutual aid members’ compliance with circumstances of preceding paragraphs and address to mutual aid members written proposals for eliminating unsafe factors and hidden dangers. The mutual aid member shall implement them in earnest.

4.10 When the mutual aid member’s pet was transferred as a gift or resold to others, the member shall follow this contract and inform the mutual aid platform promptly. If the degree of danger caused by the transfer of pets is significantly increased, the mutual aid platform may cancel the contract according to the actual situation within 30 days as of the date of receipt specified in the preceding paragraph. 

4.11 During the validity period of the mutual aid contract, expired pet registration certificate/animal health immunization certificate, lost pet, and other situation, the mutual aid member shall notify the mutual aid platform in both by written and by telephone within five days. The mutual aid platform may cancel the contract according to the actual situation.If the mutual aid member fails to make the notification stipulated in the preceding paragraph, the insurance incident that has occurred due to a significant increase in the degree of danger will not be borne by members within mutual aid platform.  

4.12 When a mutual aid member receives a damage claim from the victimized third party (as defined in Article 12.3), he/she shall immediately inform the mutual aid platform.Without the written consent from the mutual aid platform, the mutual aid member’s commitments, refusals, bids,contracts, payments,or compensations to the victim shall not be restricted by the mutual aid platform.The mutual aid platform reserves the right to invite the third party to review on the mutual aid member’s promised or paid compensations.If the compensations do not fall within the scope of the mutual aid plan’s liability or exceed the liability limits, mutual aid members shall not be liable for compensations under the mutual aid platform sub-item.

5.Management and Administration Fees
5.1 For members who join the program for the first time, management and administrative fees during the Waiting Period are remitted. After the Waiting Period, the charge is 0GETX/person/day.

5.2 Regardless any reason for the member withdrawing from the Program, paid management and administration fees will not be refunded.

6.Mutual Aid Application Procedures
The procedures of application due to Pet Owner’s liability for mutual aid as followings:

6.1 The mutual aid applicant shall submit various supporting documentations for the mutual aid incident in accordance with the requirement of insChain Mutual Aid Platform and within 7 days upon the receipt of application by insChain Mutual Aid Platform.

6.2 insChain Mutual Aid Platform will entrust the independent third party evaluation institutions or relevant experts to conduct evaluations and identifications of the mutual aid incident after receiving supporting documentations in order to establish the conclusion of investigations. Any controversial or doubtful incident shall be under the review of insChain Mutual Aid Platform experts.

6.3 In terms of a clearly defined mutual aid incident, it shall be reviewed within 60 working days after the mutual aid applicant’s documentation submission. In terms of a particularly complex event, it shall be reviewed within 120 working days.

6.4 Where mutual aid incidents conform to rules of this Program upon review, insChain Mutual Aid Platform will publicize incidents on a regular monthly basis for a period of 7 days, during which queries from other mutual aid members will be accepted; Where mutual aid incidents do not conform to rules of this Program upon review, insChain Mutual Aid Platform will notify mutual aid applicants.

6.5 insChain Mutual Aid Platform will calculate the equally distributed amount for each mutual aid member at the following day after the expiration of the publicity period of the mutual aid incident and transfer out the mutual aid fund from each mutual aid member personal account on the Platform.


6.6 insChain will make a lump-sum mutual aid payment to the mutual aid applicant within 3 working days after the mutual aid fund collection thereof.

6.7 In the event of any evidence-based objection to the mutual aid incident proposed by any mutual aid member during the publicity period, insChain Mutual Aid Platform will require the mutual aid applicant to make explanations or submit supplementary materials in accordance with the objection. And it will be conducted another round review of the mutual aid incident.

6.8 The applicant shall raise the request for mutual aid support to insChain Mutual Aid Platform within 15 days which calculated from the date that he/she have known/should know the occurrence of the mutual aid incident.

7.Circumstances of Mutual Aid Denial
The mutual aid member has one of following circumstances or in connection with any of the following circumstances due to the loss of Pet Owner’s liability. Other mutual aid members are not obligated to provide mutual aid assistance: 

7.1 The mutual aid member has yet to obtain his/her membership or has been denied of the membership;

7.2 The mutual aid member in his/her participation in the Program, or the applicant during the investigation of the mutual aid event, provides false information (including false contact information). He/She intentionally conceals facts or fails to fulfill the duty of disclosure; 

7.3 Due to against interests of others, the mutual aid members intentionally condone or instigate compensation liability caused by the canine pet for mutual aid;

7.4 Non-mutual aid member’s dog or non-authorized by government mutual aid member’s dog causes compensation liability due to against interests of others;

7.5 Liability for biting or other pets’ death by biting caused by the mutual aid member’s dog;

7.6 Liability for atmospheric,land and water pollution and other various pollution caused by the mutual aid member’s pet;

7.7 Due to the victim’s personal default/illegal behavior, the mutual aid member’s dog causes the victim injury,death, or property damage; 

7.8 The mutual aid member, his/her family members(as defined in Article 12.4),his/her employment relationships,or labor relationships personal have injury, death, or property damage;

7.9 Commercial activities allowing by mutual aid canine pet to participate;

7.10 Any fines, penalties, punitive damages;

7.11 The mutual aid member’s dog are left unattended for three days in a row;

8.Required Documentations for Mutual Aid Application

8.1 Both valid original and copy national identity card from the mutual aid applicant and the victimized third party’s valid copy for national identity card (as defined in Article 12.1) 

8.2 Pet Dependency Certificate, Animal Health Immunization Certificate,and Annual Inspection Certificate

8.3 The original invoices, documents, and medical certificates issued by medical institutions at or above the second-level (including level 2); if any death or disability occurs,the death or disability certificate is required

8.4 Valid legal documents (including ruling,awards,judgments,conciliation documents,ect.)or the compensation agreement reached in advance by the mutual aid platform with the third party

8.5 The mutual aid fund application and accident information explanation 

8.6 Proof of participation in the Program

8.7 Other certificates and documentations related to the confirmation of the nature and causes of accidents required by the insChain mutual aid platform

8.8 If above evidence and information are incomplete, or the nature and reasons of the mutual aid incident needed further considerations,the insChain shall promptly inform the mutual aid applicant to supplement the relevant certifications and information

8.9 The mutual aid review use the information submitted by the applicant for the first time as priority.If the applicant submits contradictory proofs or artificially modifies submission contents,the Platform reserves the right to refuse applications and terminate the mutual aid


9.Information Disclosure
In order to enunciate the principle of fairness, justness and transparency, insChain Mutual Aid Platform has formalized following provisions in terms of information disclosure:

9.1 Timely Disclosure:

9.1.1 insChain Mutual Aid Platform provides each mutual aid member with an independent personal account and ensures that the member can have access to the details of his/her own account at any time.

9.1.2 insChain Mutual Aid Platform establishes a personal virtue book to record details of mutual aid fund and its total amounts; Members can have access to each distribution of payment including mutual aid subjects and amounts.

9.1.3 insChain Mutual Aid Platform will publicize the number of participants in the mutual aid events, the amount of the single fund-raised, the number of people who have received the mutual aid, and the total amount of mutual aids in a timely manner.

9.2 Regular Disclosure:
9.2.1insChain Mutual Aid Platform will publicize mutual aid events of the current month that conform to regulations of the Program on a regular monthly basis and welcome queries and lawful investigations from other mutual aid members. In order to confirm the authenticity of the mutual aid incident, the mutual aid member agrees that insChain Mutual Aid Platform may publicize real identity information of applicants, the process of the event, and its details to other mutual aid members and disclose the relevant materials to the application for mutual aid.

9.2.2 insChain Mutual Aid Platform will publicize the list of mutual aid applicants of the current month and the mutual aid events challenged by mutual aid members (if any) on a monthly basis mutual aid members to review. 

9.2.3 insChain Mutual Aid Platform will publicize its semi-annual work report and annual work report regularly.

10.Member’s Privacy Protection

10.1 insChain Mutual Aid Platform will fulfill reasonable obligations to protect the private information of its members.

10.2 The mutual aid members have the obligation to protect the privacy of other members, especially deceased accidental mutual aid members, and are prohibited from disclosing the personal information of other mutual aid members.


11.Other important information

11.1 If the mutual aid member is involved in mutual aid fund fraud via material fabrication, insChain Mutual Aid Platform will unilaterally deprive them of their membership and prohibit their participation in the Platform throughout their lives; if insChain Mutual Aid Platform has already launched the mutual aid for them, it shall have the right to recover the mutual aid fund and refund other mutual aid members through lawful means. 

11.2 Mutual aid is not equivalent to insurance. insChain Mutual Aid Platform does not make warranties with respect to the total amount of each mutual aid fund. 

11.3 In the event of a large quantity of participants in the Program, insChain Mutual Aid Platform shall reserve the right to divide the mutual aid members from the Program into several mutual aid groups in accordance with management needs.

11.4    insChain Mutual Aid Platform shall have the right to modify the rules of the Program from time to time in accordance with factual situations. Once the modification is made, the platform will fully replace previous rules with the modified version and inform all members in the same way as before. Modified rules shall take legal effects once publicized on insChain Mutual Aid Platform. Mutual aid incidents and all relevant services shall be subject to new rules after modifications.

11.5 If a member does not accept modifications to regulations, he/she may terminate the use of service provided by insChain Mutual Aid Platform at any time, withdraw from the Program, and apply for the refund of the balance in his/her account. The retention of membership of a mutual aid member shall be deemed as his/her acceptance of modifications thereof and to be bounded by corresponding terms and conditions. 

11.6 During its engagement in Internet services, insChain Mutual Aid Platform may be affected by unstable factors in each step. The services have risks of services interruption and failure to satisfy the needs of the members due to force majeure, computer virus, hacker attacks, systematic instability, location of members, failed communications with members and other reasons of techniques, network and telecommunication lines. The Platform makes no warranties and shall not be held responsible for members’ failure of sending, receiving and reading messages or errors in sending and receiving messages incurred thereby.

11.7 The member has obligations to log in to check information. The member may not hold the Platform accountable on the grounds of any failure to receive the notification from insChain Mutual Aid Platform.


11.8 In case of systematic failure from insChain Mutual Aid Platform that affects the normal functionality of services, insChain Mutual Aid Platform undertakes to cooperate with relevant departments at first time to address the problem and conduct repairing. However, insChain Mutual Aid Platform shall not be liable for any consequential losses caused thereby. In addition, insChain Mutual Aid Platform reserves its rights to suspend any part of services without prior notifications for the purpose of maintenance, servicing, upgrade or others.

11.9 insChain Mutual Aid Platform is a community platform, which shall not be held responsibility for any dispute to irrelevant mutual aid events among mutual aid members.

11.10   When a member is involved in the blatant insults,defamation of others/the Platform, or other malicious attacks, insChain Mutual Aid Platform shall reserve the right not to provide services to such a member and the right to recover the loss caused by this member.

11.11 insChain Fund and insChain Mutual Aid Platform reserve the right of interpretation of the regulations for the Program.

12.Definitions
Valid Identity Document: Refer to the document that is able to certify the identity of a mutual aid member as specified by the competent departments of the government in the country and region where the mutual aid member is located.

12.2 Legal breeding: Refer to the insured’s maintenance of pets complies with national and local regulations on pet management laws,regulations, and relevant administrative regulations. The raised pets have valid pet registration certificates, animal health immunization certificates,and pass annual inspections.

12.3 Third party: Refer to any person other than the insured person, his/her family members,the sojourner,the resident who lives with insured person, and mentioned person’s employees/housekeeping service personnel.

12.4 Family members: Refer to the insured’s immediate family,spouse, adoptive parents or step-parents who have foster relationships,parents-in-law,adoptive children/step-children who have foster relationships,siblings, half-sisters,half-brothers, step-brothers and sisters, or step-brothers and sisters who have foster relationships.

12.5 Other non specified definitions in this Regulation shall be subjected to the provisions in insChain Mutual Aid Platform Member Covenant.
